As I have previously blogged about, although many states have legalized the medical use of marijuana, the possession and use of marijuana is still federally prohibited, including in relation to the possession of firearms and ammunition. Recently, the Maryland State Police (MSP) updated the form utilized to purchase a handgun to authorize it to obtain medical marijuana records.
As you can see from the above screenshot (which was posted by 2A in MD), the purchaser now authorizes the MSP to obtain information regarding their medical marijuana usage. Although the MSP’s authority to force an individual to disclose protected medical records and the safeguards enacted to ensure the protection of any such records in the MSP’s possession are questionable, it is important to reiterate that a medical marijuana user is prohibited under federal law from purchasing and possessing firearms and ammunition and it appears that the MSP is preparing to deny any application for purchase by a medical marijuana user.
